NCCAREERS.ORG

NCcareers.org (“NCcareers”) is a one-stop career information system providing comprehensive career information, resources and services that enable North Carolinians to make successful education and career decisions. NCcareers is operated by the NCcareers Governance Committee and is the product of a collaboration between North Carolina state agencies and state education associations that is designed to meet the common occupational information, education, economic development, and workforce goals of the State. The NCcareers Website is composed of various web pages operated by the NCcareers Governance Committee.

AGREEMENT BETWEEN USER AND NCCAREERS

The NCcareers Website is offered to you conditioned on your acceptance without modification of the terms, conditions and notices contained herein. Your use of the NCcareers Website constitutes your agreement to all such terms, conditions and notices.

MODIFICATION OF THESE TERMS OF USE

NCcareers reserves the right to change the terms, conditions, and notices under which the NCcareers Website is offered in our sole discretion at any time, including but not limited to the changes associated with the use of the NCcareers Website. Your continued use of the NCcareers Website following the posting of revised Terms of Use means that you accept and agree to the changes.


NCcareers reserves the right to disclose aggregated data, or information or statements we publish without attribution to any identifiable individual, specific data or statements that you separately and specifically agree we can share with the larger public or media, without infringing upon the user's confidentiality.

IP ADDRESSES

When your web browser or email application requests a web page or email from another computer on the Internet, it automatically gives that computer the address where it should send the information. This is called your computer’s IP address. The NCcareers Website may collect IP addresses for purposes including, but not limited to, system administration and auditing the use of this site. Although the NCcareers Website may log your IP address, it will not generally link your IP address to anything that would enable a third party to identify you. However, the NCcareers Website may use IP addresses to identify a user when it is necessary to enforce compliance with NCcareers Website Terms of Use or other terms of service or to protect our service, site, users, or others.

COOKIES and PIXEL TAGS

Some pages on this site may use “cookies” that are small files that the site places on your hard drive for identification purposes. A cookie file can contain information such as a user ID to track the pages visited, but the only personal information a cookie can contain is information you supply yourself. NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the NCcareers Website, you warrant to NCcareers that you will not use the NCcareers Website for any purpose that is unlawful or prohibited by these terms, conditions and notices. You may not use the NCcareers Website in any manner, which could damage, disable, overburden, or impair the NCcareers Website or interfere with any other party's use and enjoyment of the NCcareers Website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the NCcareers Website, including, but not limited to, data mining, robots, or similar data gathering and extraction tools.

PASSWORDS AND ACCOUNT SECURITY

You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the NCcareers Website. Accordingly, you agree that you will be solely responsible to NCcareers for all activities that occur under your account. If you become aware of any unauthorized use of your password or of your account, you agree to notify NCcareers immediately at 919-707-1500 or nccareers@nccommerce.com. You agree to not share access to the NCcareers Website.

DATA SAVED TO NCCAREERS

Data residing on the NCcareers Website server is password protected, and access is provided only to the account holder who created the password, anyone to whom that account holder entrusts the password, those employees who require such access to administer and maintain the NCcareers Website or to provide requested customer support to users of the NCcareers Website, and those staff of NCcareers who require such access to create reports based on aggregated information that is rendered no longer personally identifying in the aggregation process. Certain account information may also be shared with other authorized individuals such as guidance counselors or career counselors, upon consent from the account holder.

PRIVACY AND PERSONAL INFORMATION

For information about the data protection practices associated with NCcareers, please read the NCcareers.org Privacy Policy. You agree to the use of your data in accordance with these Terms of Use and the NCcareers.org Privacy Policy.

NOTICE THAT SITE MAY CHANGE WITHOUT NOTICE

This site is provided as a public service. This site is dynamic and will change over time without notice. Users of this site are therefore fully responsible for checking the accuracy, completeness, currency and suitability of this site themselves.

SECURITY AND MONITORING NOTICES

For site security purposes, and to ensure that the NCcareers Website remains available to all users, all network traffic is monitored to identify unauthorized attempts to upload or change information, or otherwise cause damage or conduct criminal activity. Except as prohibited by law, you will hold NCcareers, the NCcareers Governance Committee and the NCcareers staff harmless for any indirect, punitive, special, incidental or consequential damage, however it arises (including attorneys' fees and all related costs and expenses of litigation and arbitration, or at trial or on appeal, if any, whether or not litigation or arbitration is instituted), whether in an action of contract, negligence or other tortious action, or arising out of or in connection with these Terms of Use, including without limitation any claim for personal injury or property damage, arising from (i) your use of and access to the NCcareers Website; (ii) your violation of any of these Terms of Use; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the NCcareers Website.

TERMINATION/ACCESS RESTRICTION

NCcareers reserves the right, in its sole discretion, to edit, refuse to post, or remove any information or materials, in whole or in part, or to terminate your access to the NCcareers Website and the related services or any portion thereof at any time, without notice.

INTERNATIONAL USERS

NCcareers makes no claims regarding access or use of the NCcareers Website or NCcareers content outside of the United States. If you use or access the NCcareers Website or NCcareers content outside of the United States, you are responsible for compliance with the laws and regulations of your jurisdiction as well as these Terms of Use.

PERPETUITY RIGHTS

When these Terms of Use come to an end, all of the legal rights, obligations and liabilities that you and NCcareers have benefited from, been subject to (or which have accrued over time whilst the Terms of Use have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of the Terms of Use shall continue to apply to such rights, obligations and liabilities indefinitely.

GENERAL LEGAL TERMS

The Terms of Use constitute the whole legal agreement between you and NCcareers and govern your use of the NCcareers Website, and completely replace any prior agreements between you and NCcareers in relation to the NCcareers.


Unless you have been specifically permitted to do so in a separate agreement with NCcareers, you agree that you will not reproduce, duplicate, copy, sell, trade or otherwise distribute content from the NCcareers Website for any purpose.


You agree that you are solely responsible for (and that NCcareers has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which NCcareers may suffer) of any such breach.


You agree that if NCcareers does not exercise or enforce any legal right or remedy which is contained in the Terms of Use (or which NCcareers has the benefit of under any applicable law), this will not be taken to be a formal waiver of NCcareers’ rights and that those rights or remedies will still be available to NCcareers.


If any disagreement or dispute arises regarding these Terms of Use or any rights or obligations conveyed hereunder, the disagreement shall be resolved, whenever possible, by meeting and conferring. If such efforts are unsuccessful, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.


The Terms of Use, and your relationship with NCcareers under the Terms of Use, shall be governed by the laws of the state of North Carolina, without regard to conflict of laws provisions. You and NCcareers agree to submit to the exclusive jurisdiction of the courts located within North Carolina to resolve any legal matter arising from the Terms.


If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms of Use is invalid, then that provision will be removed from the Terms of Use without affecting the rest of the Terms of Use, which will remain in full force and effect.
